Terms of Service

Your input stays yours. Your prompts, files, and images are your content. We claim no ownership of them and use them only to operate the service: storing them, processing them through the model, and showing them back to you. Ache does not use your content to train models or show it to other users.

Output is yours to use. Whatever Ache generates for you is yours — commercial use included, no attribution required, no licence fee.

If you use bring-your-own-key (BYOK) provider keys, requests are routed to that provider under its API terms for training, retention, and zero-data-retention. Ache still proxies the request and stores chat history unless you use Incognito. We store BYOK keys encrypted and do not use that traffic to train Ache models.

Credit-funded models may route through Ache ZDR (default — Zero Data Retention providers on OpenRouter, data_collection: deny, no training) or, if you opt in to Expanded Model Access, Ache Expanded for OpenRouter models without a ZDR provider (upstream providers may retain sanitized prompts; OpenRouter guardrails are not infallible). • Generated text is not guaranteed to be original or free of third-party rights. If you need clean ownership, get it checked.
• The same prompt can produce similar output for someone else. You are not granted exclusivity over anything.

Ache's software, name, and design remain ours. Nothing here gives you a licence to them.

Ache is a hosted AI platform for developers and teams — chat, an OpenAI-compatible /v1 API, CLI and Desktop integrations, Code mode, team workspaces, and optional BYOK model routing. We operate the infrastructure and apply the security practices described in our Privacy Policy and Trust Center.

Like any online service, availability and model availability can change. We recommend exporting important work and reviewing AI output before production use. Usage limits and credits may apply where shown in the product.

Unless you have a separate signed agreement with us, the service is provided without a formal service-level agreement or guaranteed uptime. Optional crypto top-ups, when offered, are final once confirmed on-chain; credits are consumed per product rules shown in the dashboard.

Use a real email address you control — password resets go there, and it is how we verify a deletion request is really from you. Pick a password you do not use anywhere else.

Everything done through your account or your API keys is treated as done by you. Keep them to yourself. An API key is displayed once when created and can be revoked from the dashboard at any time; revoke immediately if a key leaks, and tell us at [email protected] if you think your account has been taken over.

One account per person. Do not create extra accounts to get around a limit or a ban.

The short version: do not use Ache to hurt people, and do not use it to attack the service itself.

Specifically, do not:

• break the law with it, or generate content that is illegal where you or we are — sexual content involving minors most emphatically included;
• harass, threaten, stalk, defame, or impersonate anyone, or generate material designed to do that to a specific person;
• build malware, exploits, phishing pages, or spam campaigns, or use Ache to plan attacks on systems you do not own;
• look for step-by-step help creating weapons capable of mass harm, or anything else whose obvious purpose is serious physical injury;
• upload other people's personal data, credentials, medical records, or confidential material you have no right to share;
• evade rate limits, bans, or authentication — that includes rotating accounts, scripting around limits, probing for vulnerabilities without permission, and trying to reach other users' data;
• resell access, run Ache as the backend of a competing product, or scrape the service at volume;
• present Ache's output as human-written where that misleads someone in a way that matters, or claim it as an official statement from us.

Genuine security research is welcome — contact [email protected] first — and do not test against other users' accounts or data.

Code mode can inspect and change a repository in an isolated workspace, create commits and pull requests, and—when you explicitly connect them—work with GitHub, Vercel, and Supabase. It is a powerful convenience feature, not a substitute for review.

• You are responsible for every repository, deployment, database, token, webhook URL, and team member you connect or invite. Only connect services and projects you are authorised to administer.
• Review proposed code, SQL, pull requests, environment-variable changes, and deployments before approving them. AI can make destructive or insecure changes even when its plan sounds sensible.
• Team owners and admins are responsible for their members, shared keys, team memory, budgets, integrations, webhook destinations, and notification recipients. Do not add someone to a team or project unless they are entitled to see its material.
• Disconnect integrations and revoke the underlying provider credential if you no longer trust a connection. Disconnecting it from Ache stops future use, but it cannot undo a change already made at the connected provider.

AI output can be inaccurate. Ache may state wrong facts confidently, invent citations, misread images, or summarise sources incorrectly. Verify important results before you rely on them.

Do not rely on Ache for medical, legal, financial, or safety-critical decisions without checking with a qualified human first. That includes diagnosing symptoms, dosing medication, interpreting a contract, choosing investments, and anything involving structural, electrical, or vehicle safety. It is not a doctor, a lawyer, or an engineer, and it will not tell you when it is out of its depth.

Web search results come from a third-party index and inherit whatever is wrong on the pages they cite. Open the sources.

You are responsible for what you do with the output, including anything you publish or act on.

We may suspend or delete an account that breaks these terms, abuses the service, or puts the service or other users at risk. Clear-cut cases — attack traffic, illegal content, ban evasion — may be acted on immediately. Other cases usually receive a warning first where practical.

If you think a suspension was a mistake, email [email protected] from your account address. We review appeals promptly.

You can stop using Ache whenever you like. You can delete your account from Dashboard settings after confirming your password; see the retention section of the Privacy Policy for what that removes.

If we discontinue the service deliberately, we will give reasonable advance notice so you can export what you need.

Ache is provided as is and as available, with no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.

We work to keep Ache available and your data safe, but we cannot guarantee uninterrupted service, that data will never be lost, or that every feature will remain unchanged. Export important work from your dashboard. Where your local law does not permit these disclaimers, they apply only as far as it does.

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, nor for lost profits, lost data, lost business, or the cost of substitute services, arising from your use of Ache or your reliance on anything it generates.

For any claim that does succeed under these online Terms, total liability is capped at the greater of what you paid to use Ache in the twelve months before the claim or 100 USD. A separate signed agreement with Ache AI may specify different limits for covered business use.

If you are a consumer using Ache for personal (non-business) purposes, mandatory consumer-protection laws in your country may give you rights that override these limits.

None of this limits liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or anything else that cannot lawfully be excluded.

You agree to cover our reasonable costs if a third party brings a claim because of how you used the service or what you put into it.

These online Terms apply to self-serve accounts. If you use Ache on behalf of an organisation, a signed Data Processing Addendum (DPA), order form, or master service agreement may supersede conflicting online terms for covered use — including retention, subprocessors, liability, and service levels where negotiated. The DPA is not effective until the parties execute or accept it as described in the DPA itself.

Request Ache's standard DPA by contacting [email protected]. For subprocessor schedules and security questionnaire responses, contact [email protected]. We respond to verified business requests within 30 days.

These terms can be updated as the service changes. The date at the top moves when they do. Material changes are announced in the app or by email at least 30 days before they take effect where practicable. If you use Ache on behalf of an organisation with a signed DPA or order form, subprocessors and material processing changes follow the notice period in that agreement when it differs. Continuing to use Ache after that means you accept the new version. If you do not, stop using the service and request deletion.

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Disputes go to the courts competent in the State of Delaware unless mandatory consumer-protection law where you live requires otherwise.

Your statutory privacy rights are described in our Privacy Policy and are not limited by these Terms except where applicable law permits.

If any part of these terms is found unenforceable, the rest stays in force and the unenforceable part is narrowed to what is allowed. Not enforcing something once does not waive it. Together with the Privacy Policy, this is the whole agreement between you and us about Ache. Contracting party: Ache AI.
